Terms of Service

These terms apply when you use this website, submit the enquiry form, or engage coldmath to build or manage your website and online presence. Where we have signed a separate written agreement with you, that agreement wins on anything these terms contradict.
1. Who we are
coldmath is a web design and local-search agency based in Tirunelveli, Tamil Nadu, India. Contact: [email protected].
2. Using this website
You may read this site and submit an enquiry. You may not attempt to break into it, scrape it at a scale that degrades it for others, or submit the form with someone else's details.
3. Enquiries and the free report
Submitting the form is a request for contact, not a contract. We aim to reply on WhatsApp within one working day, and to send a free website check-up within two working days. Neither is a guaranteed timeline, and we may decline to work with anyone.
4. Our services
What we build for you, what it costs, and when it is delivered are set out in the proposal or agreement we sign with you. In general:
- We build and maintain websites, and manage Google Business Profiles and local search presence.
- Work begins when the proposal is accepted and any advance payment is received.
- Changes beyond the agreed scope are quoted separately before we start them.
- We depend on you for content, images, approvals and access to your accounts. Delays there move delivery dates.
5. Fees, payment and recurring billing
- Prices are quoted in Indian Rupees and, unless stated otherwise, exclude GST.
- Retainers are billed monthly in advance.
- Where you set up automatic payment, the mandate is registered through our payment provider. You will receive notice before each debit and can cancel the mandate at any time through your bank or UPI app.
- If payment fails we will tell you and try again. If an invoice stays unpaid, we may make your dashboard read-only after a grace period, and suspend work until it is settled.
We never take payment card details ourselves. Payments are handled by our payment provider.
6. Results
We measure what we do and report it honestly. We cannot promise a specific ranking on Google, a specific number of enquiries, or a specific revenue figure, because those depend on Google, your market and your own follow-up. Any figures shown on this site are past results for particular clients and are not a promise of your results.
7. Ownership
- Your content — text, images, logos and data you give us remain yours.
- The finished website — once you have paid in full, it is yours.
- Our tools — the internal systems, dashboards and methods we use to deliver the work remain ours.
- Your accounts — your domain, hosting and Google Business Profile stay in your name. We ask for access, not ownership.
- You confirm you have the right to use any content you give us. If a third party claims otherwise, that is your responsibility.
8. Showing your project in our portfolio
We may show your website and its published results as an example of our work. Tell us if you would rather we did not, and we will not.
9. Ending the engagement
- Either of us may end an ongoing retainer with 30 days' written notice.
- Fees for work already done remain payable. Prepaid fees for work not yet started are refunded.
- We may suspend or end an engagement immediately for non-payment, or if we are asked to do something unlawful.
- On request within 30 days of ending, we will hand over your site files and transfer account access back to you.
10. Liability
We will do our work with reasonable care and skill. To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose, and we are not liable for lost profits or lost business. Nothing here limits liability for fraud or anything else that cannot lawfully be limited.
11. Third-party services
Delivery depends on services we do not control, including Google, your domain registrar, your hosting provider and payment providers. We are not responsible for their outages, policy changes or account decisions, though we will help you deal with them.
12. Privacy
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
13. Changes to these terms
We may update these terms. The version published here when you engage us is the one that applies to that engagement. Material changes affecting existing clients will be sent by email.
14. Governing law
These terms are governed by the laws of India. Disputes are subject to the courts of Tirunelveli, Tamil Nadu.
